When a dispute arises regarding a will, a trust, or the administration of an estate, you can count on our estate lawyers at JDKatz to represent your interests.

Estate planning documents are complicated and it can be difficult for individuals to understand their obligations, rights or interests under these documents, including wills, trusts, and powers of attorney.

We represent individuals involved in will, trust and estate contests (i.e., contesting the validity of the will or trust), in resolving disputed terms of a will or trust, in resolving claims against an estate, and in resolving the rights and obligations of beneficiaries and fiduciaries (i.e., the trustee or the executor).

Similarly, the individuals who have been appointed a fiduciary under an estate planning document (the trustee of a trust or the personal representative/executor of an estate) have a fiduciary duty to the beneficiaries of the will or trust.  It can be difficult for trustees, executors, and personal representatives to understand their obligations, especially when facing vocal demands from beneficiaries.  Our estate lawyers advise trustees, executors, and personal representatives as to how to administer the estate or the trust and protect themselves from claims of breach of fiduciary duty.

We also represent and advise individuals who have been appointed attorney-in-fact under a power of attorney document.  The responsibilities of the attorney-in-fact are many, and it can be overwhelming to serve in this role.  We advise attorneys-in-fact under power of attorney documents of their rights and obligations to take action on behalf of their principal.

When litigation arises on any of these issues, we are well-versed in the intricacies of trust and estate law and can represent our clients’ interests in court.  Probate court, in particular, can be a complicated place to practice law, and our estate lawyers understand the intricacies of practice before the probate courts of Maryland and the District of Columbia.
